Nintendo fighting Rare over Banjo?

Hey, this rumour has been floating around the Rareware forums:
The reason why Rare hasn't said anything on Banjo is that they are currently fighting over who owns the license.
Rare claims it went with them to Microsoft,
and although publicly Nintendo agrees I think they are still fighting.
I hope Nintendo wins, and they might be fighting over Perfect Dark since Nintendo was ABOUT to register the license.

I don't think they are fighting over them but they have good reason to. The whole DK family belongs to Nintendo. Rare made Diddy but he belongs to Nintendo since Rare put him into the Donkey Kong franchise. So, keep up with me here people...Diddy belongs to Nintendo, and guess where Banjo AND Conker both first appeared in. None other than Diddy Kong Racing, so if Nintendo got Diddy, a Rare made character, for first appearing in a Donkey Kong game, they should get to keep Conker and Banjo. Though I'd rather have Jet Force Gemini than Conker and nobody has mentioned who get's rights to them but I think it would be Rare and they probably announced that way back when but who cares.

Then agian..They were original characters. If nintendo said " You may use this set of characters, now add some of your own" things would differ.

It is hard to break apart two company that were very intergrated. I supposed an arguement example would be " If Namco Adds a BobCat in Starfox armada...Can they use him in other games of thier own without a licence from Nintendo?

oh man...bunch of banjo blues in here. screw banjo and the "naughty-mouth" squirrel himself. perfect dark is the kind of game that the GCN could use. speaking of which...have you seen what microsoft has done to our lovely joanna dark? they turned her into what appears to be a typical teenage girl w/ too much makeup. wtf? i read somewhere they were gonna make her more "girlie" or some shit like that. i mean, i prefer the kickass, takes-no-bullshit-from-anybody duchess of the dark. i mean, who wants a game where your shooting down enemies and you hear your character say, "Oh, no! i broke a nail!" ?

Rare would not have put Banjo into their X02 video, when Microsoft acquired them, if they did not own all rights to him. Otherwise Nintendo would've sued them for using a property that belonged to them. But hey, they didn't, and Rare owns everything they've used except StarFox and Donkey Kong. Simple as that.

I didn't get too much time with it but I liked what I played.

Banjo and Conker are intellectual properties developed by Rare who would retain the rights to those properties unless they were sold. If Rare at one point sold those properties to Nintendo and now Rare is trying to use them without getting the license from the property owner (Nintendo in this hypothetical situation) then yes, Nintendo could sue Rare.
