PlayStation® Underground™ PLAYSTATION®3 Premiere Event—National Web Contest
OFFICIAL RULES
NO PURCHASE NECESSARY. MAKING A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. Must be 18 years of age or older. Void outside the 50 United States of America and Washington, D.C., and where prohibited by law. To enter, submit one of the following: a video "screen test" of yourself, an essay, poem, PowerPoint® or any other creative presentation that shows us why you deserve to go to the PLAYSTATION 3 Premiere Event. Entries can be sent via mail to: PLAYSTATION 3 Premiere Contest, P.O. Box 1998, Santa Monica, CA 90406, OR via email to community_support@playstation.sony.com. Videos that are sent via mail must be submitted in the form of a VHS, CD, or DVD format disc. To send a video via email, host the video on another site and email a link to the downloadable or playable file to the following address: community_support@playstation.sony.com. Essays and poems must be limited to 1000 words and PowerPoint presentations must be limited to 20 slides. (Hereinafter "Submission"). With your Submission please send (i) your Submission; (ii) your name, address, date of birth, phone number and email address. All Submissions must be clearly and legibly labeled with your name and address, must be the fully original creations of the entrant, and must have never been published or professionally developed. All Submissions must be received or emailed by October 15, 2006, 11:59 PM (PST). One Submission per person. Sony Computer Entertainment America Inc. ("Sponsor") is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions; lost, late, mutilated, illegible, incomplete, postage due or misdirected Submissions. All Submissions become the sole property of Sponsor and none will be returned. In the event that fewer entries are received than the number of prizes to be awarded, Sponsor reserves the right to take action as it reasonably deems necessary under the circumstances. Entrants waive any claims against Sponsor, and its affiliates, licensees, successors and assigns concerning Entrants' rights in the Submission submitted under this Agreement. Entries not satisfying these Official Rules will be automatically disqualified.
JUDGING CRITERIA: All entries will be judged by an expert panel from the Direct Partners Marketing Agency. Judging of the entries will begin on or about October 15, 2006, with a final decision to be made on or about October 15, 2006. The decision of the judges will be final and binding in all respects. By participating, entrants agree to be bound by the Official Rules. Judging Criteria: gaming enthusiasm, creativity, individuality, expressiveness and sense of humor and entrant's ability to express him/herself. Sponsor reserves the right to reject any Submission that it deems, in its sole discretion, to be inappropriate, including, but not limited to, gratuitous depictions of violence or sexual behavior, or positive depictions of alcohol or tobacco. The Submission must be the original, unpublished and sole work of the entrant. The Submission cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third-party personal or proprietary rights. Any entrant whose Submission includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of buildings, trademarks or logos) must be able to provide legal releases for such use, including Sponsor's use of such elements, in a form satisfactory to judges. Winners will be selected from all eligible entries received via email or postmarked by mail on or before October 15, 2006, 11:59 PM (PST).
WINNERS: Ten (10) winners will win the opportunity to go to the PLAYSTATION 3 Premiere Event, scheduled for November 8, 2006, in Los Angeles, CA. Each prize package will include one (1) round-trip coach-class airfare to Los Angeles, California, from a major airport closest to winner's home, two (2) nights' hotel accommodations, one (1) invitation to the PLAYSTATION 3 Premiere Party, one (1) PLAYSTATION 3 system (subject to availability - please allow up to 20 weeks for delivery), a two (2) day per diem of $75 (a check in the amount of $150.00 payable to winner's name), (approximate retail value: $2,200). All travel details will be at Sponsor's discretion. Prize will be forfeited if winner is unable to travel during designated time period. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the sole responsibility of winner. If, in the judgment of Sponsor, air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsors' sole discretion. Sponsor reserves the right to substitute a prize of equal value if prize is unavailable. Prizes are non-transferable and no substitutions are allowed. Winners shall be notified by email and/or telephone. Once notified, allow 3 days for delivery of prize affidavit. Air travel arrangements will be made once the prize affidavit is returned (see details on executing a notarized Affidavit of Eligibility and Release under GENERAL, below).

Return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner will be selected. Affidavit must be signed and returned within the stated time period or prize may be forfeited. Additionally, as a condition to receiving the prize, the winners shall be required to execute an assignment transferring and assigning all of his or her rights, title and interest, including but not limited to any copyrights or trademarks, in the Submission submitted as an entry to Sponsor. Sponsor is under no obligation to use the winning Submission in any media. Winners agree to the use of their names and/or likenesses for purposes of advertising, trade, or promotion without further compensation, unless prohibited by law. Additionally, winners agree to release Sponsor and their respective parents, subsidiaries, agencies, divisions, and affiliates from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and claims based on publicity rights, copyright/trademark infringement, defamation or invasion of privacy and merchandise delivery. Neither Sponsor nor their respective parents, affiliates, subsidiaries, agencies, divisions nor related companies are responsible for any damages, or expenses that winners might incur as a result of this contest or receipt of prize. All taxes are the sole responsibility of the winners.
